Well, for backward compatibility, M$ will just sell the old xbox / 360 game again on their xbox market place again, they probaby just need a VM that run old game
For whatever reason, It will be a marketing backlash if M$ states outright "not compatible with X360 games".
What M$ should've done is get a VM and say XBOne supports old game but "performance is not guaranteed".
